CASE STUDIES
DIY product catalogue
We are representing one of the largest home improvement and construction materials retailers worldwide in copyright infringement proceedings initiated in Spain against its main competitor in the European market. We argue that there has been an unlawful reproduction of our client’s catalogue both as a literary work and as a data compilation. The Seville Appeals Court overturned the first instance judgment issuing a judgment fully accepting the claims lodged by our client. Subsequently, the defendant filed a cassation appeal before the Supreme Court. The case is pending.
Circumvention of technological protection measures
We have represented a leading company in the videogames sector in several court proceedings related to the circumvention of technological protection measures embedded in video consoles and videogames. The defendants are, in all cases, distributors of devices that circumvented technological protection measures (modchips). This was the first time that Sections 160 and 161 of the Spanish Copyright Act were enforced before Spanish civil courts.
Transfer of ownership of engineering works
We have advised a client from the public works construction sector on the acquisition of an engineering studio specialized in the design of ornamental fountains for public space. The transaction included the transfer of the copyright-protected historical archives.
